OOC - Legality of Magic in Dalen and Verden

Sorry to spam this game with OOC Posts, but I feel this deserves its own area of discussion. So, the dispute over the legality of telepathy and mind control magic is getting me quite fired up, and I feel that I need to express my views of how I imagine the legal systems of Dalen and Verden view magic and law in general.

So, to start, I feel it is worth mentioning that Dalen is a state that actively promotes the institution of slavery. Historically, slavery was very profitable to certain people, and was typically viewed as a necessity by those people that profited from it. However, the one thing that generally concerns most slave owners is maintaining control over their slaves.

So, we are arguing that mind control magic should be completely illegal. I would argue that in Dalen, mind control magic should be allowed to be used on certain people, such as disobedient slaves. This highlights my generally philosophy on a system of law that makes sense for Dalen society, namely, that the legality of your actions in Dalen society depends mostly on who you are, what you do, and who you do it to (much like Hammurabi's Code), and less on how you actually go about doing something. So for instance, it is completely okay for a slave master to murder half his slaves with a psychic pulse because he fears that they are going to revolt, but it would be very illegal if he took control of one of Thalia's bodyguards in an attempt to assassinate her. This also justifies Commander Stylianne's actions against the innkeeper. As actually enforcing what magic is legal and what isn't is difficult, and, as Jaxx said, hard to prove, I would think that Dalen legal authorities would mostly consider the results of a perceived breach in the law as opposed to how the relevant parties claimed the incident in question actually went down.

The exception to this is necromancy, and that is mostly for plot reasons as opposed to philosophical ones. If necromancy was legal, Ceriden wouldn't be invested in helping Sabina.

Verden, on the other hand, I believe, is a state that went down the rabbit hole of making everything illegal in an attempt to keep it's citizenry safe from each other. By trying to forbid their citizens from being capable of hurting each other, Verden has become a police state.
